Implementation and Management of FIDIC Professional Service Agreement (2 CPD Points)

This course addresses in particular all those, (1 ) who are either involved in the procurement and the use of consultancy services for feasibility studies, design services and site supervision and also contract administration services and/ or those, who are (2 ) consultant engineers providing such services under the FIDIC White Book. The training gives you a comprehensive insight on the use of the FIDIC White Book, including claims´ management and dispute resolution.

Practical Use of the FIDIC Conditions of Contract (2 CPD Points)

Essential contractual know-how for working on today’s international projects

The FIDIC Module 1 course presents the practical use of FIDIC Conditions of Contracts on the 2017 Second Editions of Red and Yellow Books with highlights of the major development compared to the 1999 First Editions. It is aimed at providing attendees with general knowledge on the use of the FIDIC Rainbow Edition from the point of view of employers, contractors and engineers. It covers aspects of the selection of the appropriate form of contract, the preparation of tender documents and the management and administration of the contract including claim management and dispute resolution.

Management of Claims & Resolution of Disputes (2 CPD Points)

Improving Claim Management Activities from a Contractor´s, Employer´s and Engineer’s perspective. Ensuring that staff using FIDIC contracts can manage claims & disputes.

The course addresses all who are involved in the management and administration of FIDIC based contracts, with a focus on the management of Employers´ and Contractors´ claims, including the pursuit, defense, and the assessment of claims by the Engineer or Employer´s Representative. Claim Management is an element of risk management and requires a variety of skills from all who are involved. It involves programming, calculation and psychological and cultural skills. The course provides the necessary inside information. It will help to avoid inflated claims and abuse of right as well as unnecessary foreclosure of claims.

MODULE 3

Dispute Adjudication Boards (2 CPD Points)

Ensuring Experienced Practitioners Can Manage and Act upon Dispute Adjudication Boards

This practical training course or seminar, provided by a FIDIC certified and accredited trainer with extensive international experience, explains and illustrates the practical use and management of FIDIC Dispute Adjudication Boards (DABs) [1999 Ed.] or FIDIC Dispute Avoidance and Adjudication Boards [2017 Ed.] from commencement to the completion of the Works under FIDIC Conditions of Contract for Construction & Design & Build. The course or seminar is designed to help the participants have confidence in working with the FIDIC Red and Yellow Book whether representing employers, consultants or contractors. It is also aimed to provide dispute resolvers with the relevant knowledge. In addition to that, this module also includes a chapter on the use of arbitration as a final resort. Case studies are included. The tutor provides detailed checklists to support the FIDIC procedures as well as extensive engineering & contractual work exercises.

Contract Management and Administration ( 2 CPD Points)

Ensuring that FIDIC contracts are managed and administered correctly and successfully.

The FIDIC Golden Principles 2019 state that the implementation of properly prepared FIDIC contracts is as important as the proper preparation and drafting of FIDIC based tender dossiers. This practical training course explains and illustrates the practical use and management of the FIDIC Conditions of Contract for Design & Build Projects from commencement to the completion of the Contract. The course or seminar is designed to help the participants have confidence in working with the FIDIC Red and Yellow Book, 2nd Edition 2017, bearing in mind that the core aim of the majority of the changes in FIDIC’s2017 contract updates is increased clarity and certainty. Consistent with the above, FIDIC has improved the contract provisions by making them more prescriptive and introducing step-by step project management and procedural mechanisms in order to reduce the risk of disagreements regarding the interpretation of contract terms.
